Retos del Registro Cubano del Estado Civil ante las nuevas realidades tecnológicas y sociales
Abstract
En la realidad social, personal y familiar cubana, comienzan a influir cambios
tecnológicos y sociales, que han ocurrido en los últimos tiempos (parejas del mismo
sexo, transexualismo, uniones de hecho, reproducción asistida, bancos de semen, envejecimiento poblacional, entre otras). Estos cambios han influido en la composición y estructura familiar, y trascienden al derecho de la persona y la familia, con incidencia en la actividad del Registro Civil como institución encargada de atesorar aquellos hechos y actos que crean o modifican tal condición; expresión de seguridad jurídica como valor que la sociedad espera del Derecho.
La investigación que se presenta, caracteriza los principales desafíos del Registro cubano del Estado Civil, en torno a los nuevos escenarios tecnológicos y sociales que influyen en la publicidad de los estados civiles. Se aporta un material de estudio sobre el tema en el ámbito nacional, que permite la sistematización y análisis de la necesidad de ajustar el derecho que se genera en la institución registral ante las nuevas situaciones y avances tecnológicos, que reafirman al Registro del Estado
Civil como institución que procura a través de la publicidad legitimar los mecanismos
de protección personal y familiar. En orden de desarrollar la investigación fueron usados métodos teóricos como análisis -síntesis, abstracto-concreto, inductivo-deductivo, histórico-jurídico, Derecho comparado, observación, análisis de contenido de documentos, y encuesta. Cuban reality, along with its social, personal, and family settings, has been influenced by societal and technological changes for some time now (same-sex couples, transsexualism, common-law unions, assisted reproductive treatments, sperm banks, population ageing, among others). These changes, which have had an effect on the structure of family groups, transcend the rights of the individual and the family and influence the role of the Civil Registry as the institution in charge of storing the acts and facts that create or modify said conditions, which constitutes the expression of legal certainty as the value that society demands from the law.
The present research aims at characterizing the main challenges faced by the Cuban Civil Registry in regards to the new technological and societal scenarios that influence the publicity of the civil statuses. It includes updated study material about this topic in the national context that allows for the systematization and analysis of the need to adjust the law that is generated in the Registry Department to new situations and technological advancements to validate the role of the Civil Registry as the institution which seeks to legitimate mechanisms of individual and family protection through publicity.
