Un acercamiento de doctrina y legislación cubanas al contenido atípico del negocio jurídico testamentario

Abstract

El testamento por su especial relevancia, en tanto patrimonial, en el ámbito de las sucesiones, ha sido una de las instituciones que desde el incipiente Derecho Romano atravesó por una rica y en ocasiones controversial polémica. De ahí que la apertura de tal dogma a nuevas consideraciones, en cuanto al reconocimiento legal del llamado contenido atípico en dicho instrumento jurídico, constituye hoy en día una cuestión que genera inquietud para muchos estudiosos del tema. En este sentido, resulta ser la ley sustantiva cubana omisa e indefinida, por lo que la connotación del presente tema radica en considerar sobre la pertinencia de incluir en la citada norma, los elementos atípicos del testamento, como ejercicio de la libre y más amplia autonomía de la voluntad del causante. Es por ello que en la presente investigación se determinó como objetivo general: fundamentar sobre la base de los aspectos doctrinales y legislativos la necesidad de reformular la regulación jurídica civil con relación al contenido del negocio jurídico testamentario, de manera que se otorgue reconocimiento legal y total a los elementos extra-patrimoniales dentro de dicho contenido. Como estrategia para lograr el cumplimiento de los objetivos trazados, se emplearon distintos métodos de la investigación científica, tales como: el análisis-síntesis, la inducción-deducción, el histórico-jurídico, el estudio comparado y el exegético de normas. Tomando como base lo anterior, la investigación queda estructurada en dos capítulos, el primero dedicado a los fundamentos teóricos e históricos del testamento, y el segundo dirigido al estudio sobre la tipicidad y atipicidad en el contenido del negocio jurídico testamentario en la legislación civil cubana.

The testament for its special relevance, as much as patrimonial, in the environment of the successions, has been one of the institutions that from the incipient Roman Right has gone through a rich and in occasions a controversial polemic. Hence, the opening of such a dogma to new considerations, as for the legal recognition of the atypical content within this juridical instrument, constitutes today a question that generates a great concern for many specialists of the topic. In this sense, the Cuban substantive law turns out to be remiss and undefined, so the connotation of the current topic it resides in considering on the relevancy of including in the above-mentioned standard, the atypical elements of the testament, as exercise of a free and wider autonomy of the originator´s will. For this reason it was determined as a main goal in the following investigation: to base on the foundation of the doctrinal aspects and legislatives the need of formulating the civil legal regulation with relationship to the content of the probate juridical business, so that legal and total recognition is granted to the extra-patrimonial elements within the content. As strategy to achieve the execution of the objectives layouts, different methods of the scientific investigation were used, such as: the analysis-synthesis, the induction- deduction, the historical-juridical, the compared study and the exegetics of standards. Taking the above-mentioned into consideration, the investigation is structured in two chapters, the first one dedicated to the theoretical and historical foundations of the testament, and the second directed to the study on the tipicity and atypicality in the content of the legal juridical business in the Cuban civil legislation.
