La Expropiación Forzosa en el sector agropecuario : marco legal de su regulación

Abstract

El presente trabajo es el resultado de una investigación que tiene por título La Expropiación Forzosa en el sector agropecuario. Marco legal de su regulación, el cual aborda una temática necesaria y polémica; con el objetivo de identificar las deficiencias procesales y administrativas que afectan la tramitación del proceso de Expropiación Forzosa y elaborar un proyecto de medidas que contribuyan a su perfeccionamiento. Después de haber realizado diagnósticos recurrentes se decidió particularizar en la situación práctica en que se encuentra el procedimiento para la expropiación forzosa por la importancia de su incidencia en el derecho de propiedad. La tesis consta de: introducción, dos capítulos, conclusiones y recomendaciones. Se consultó bibliografía variada que permitió la fundamentación teórica y la comprensión plena del problema. Se utilizaron como Métodos Generales de la Investigación Teórica, el Método de Análisis-Síntesis, Inducción-Deducción; como Métodos Generales de la Investigación Empírica: Observación, Diagnóstico, Revisión de documentos, Grupo Nominal, como Métodos Específicos de la Investigación Jurídica; el Método Teórico-jurídico, Método Histórico-jurídico, Método Jurídico- comparado. Se obtuvieron resultados que corroboraron el cumplimiento del objetivo y las tareas científicas; y se aporta además un conjunto de medidas que pretende fortalecer jurídicamente el proceso de Expropiación Forzosa. Las recomendaciones podrán facilitar el perfeccionamiento del trabajo de las Delegaciones de la Agricultura y los Tribunales Provinciales Populares.

The present work is the result of an investigation that has for title The Mandatory Expropriation in the agricultural sector. Legal Marco of their regulation, which approaches a thematic one necessary and polemic; with the objective of to identify the procedural and administrative deficiencies that affect the procedure of the process of Mandatory Expropriation and to elaborate a project of measures that you/they contribute to their improvement. After having carried out diagnostic recurrent he/she decided to particularize in the practical situation in that he/she is the procedure for the mandatory expropriation for the importance of their incidence in the right of property. The thesis consists of: introduction, two chapters, conclusions and recommendations. Varied bibliography was consulted that allowed the theoretical foundation and the full understanding of the problem. They were used as General Methods of the Theoretical Investigation, the Method of Analysis-synthesis, Induction-deduction; as General Methods of the Empiric Investigation: Observation, Diagnostic, Revision of documents, Nominal Group, as Specific Methods of the Artificial Investigation; the Theoretical-juridical Method, Historical-juridical Method, Juridical-compared Method. Results were obtained that they corroborated the execution of the objective and the scientific tasks; and it is also contributed a group of measures that seeks to strengthen the process of Mandatory Expropriation legally. The recommendations will be able to facilitate the improvement of the work of the Delegations of the Agriculture and the Popular Provincial Tribunals.
